The Late Night Dumpster Fire Report

 The people who govern us are cowards.

The people are not. City of my birth. I am inordinately proud. 😈 The Ruth Ben-Ghiat of the right, I presume? Except this guy thinks there’s a nationwide conspiracy at work, and the solution is: arrest them all. So, no, he’s not serious, which makes my comparison inapt. This guy is a bull goose looney. How long before Noem says this about Dallas? And speaking of lawless:
Without the Insurrection Act, Marines cannot act outside Posse Comitatus. Trump has not invoked the Act here, so what’s going on? What plays on TV, that’s what. On PBS Newshour tonight, the discussion turned to what Trump did in his last term, how he reacted to video of protesters on TV. Not from intelligence reports.

Trump has absolutely no idea what governance means.

Trump wants Marines on the streets so he looks tough. That’s all he understands.

Tonight, LA police are restoring order and arresting people. The quality of those arrests is one thing. ( When there were campus protests at UT Austin over Gaza, students were arrested and taken to the DA’s office, where they were promptly released. The DA didn’t want to bother with them.) The need for any help is another.

They don’t look like they need any help.

Strong National Guard to the Texas Border enegy here:
CNN reported that 700 Marines were being sent while Bloomberg cited at least 500. CNN cited three people familiar who said that the Marines were sent to the city from the Marine Corps Air Ground Combat Center in California.

"The deployment of the full Marine battalion marks a significant escalation in Trump’s use of the military as a show of force against protesters," the CNN report said. The sources acknowledged that it's unclear what the mission is.

Marines, like the National Guard, are legally barred from serving as law enforcement.
Greg Abbot did this with the TNG in 2023. It did not go well. The soldiers had nothing to do. Morale cratered. Some went AWOL and went home. Some attempted suicide. Word is they aren’t doing better by the NG this time.

I don’t expect the Marines to do anything but be professional, but are we going to give them rubber bullets and tear gas launchers? It’s bad enough when cops shoot journalists with rubber bullets. Anecdotal evidence is the protests are peaceful for the most part. But Trump never saw a fire he couldn’t throw gasoline on.

I don’t think anybody needs to back down. But I don’t think they need to burn any more cars, either.
I’m seriously wondering if Stephen Miller didn’t do this via autopen, and Trump hasn’t heard about it yet.

We Live In Hope

I see Trump as telling somebody else “Go ahead,” but he doesn’t want to be responsible for the fallout. “I’d do it if I were him” easily turns into “But I’m not him. It turned out bad? Huh. Maybe he shouldn’t a done it.” Never gonna happen. Trump has already left that responsibility with his underlings. The sign on his desk reads “The buck goes in my pocket. How it got there, I can’t say.”
Every governor -- red or blue -- should reject this outrageous overreach.

There’s a lot of hyperbole out there. This isn’t that.

This is an unmistakable step toward authoritarianism that threatens the foundation of our republic.

We cannot let it stand.
Meanwhile, Trump is declaring victory and leaving the field.

I can see the trial court tossing it for mootness (if the troops are withdrawn). I can see the Supremes ( well, 6 of them) saying “Whatever the [right] President wants.”

I’m Just Curious

There’s a city park about 4 blocks from my house. Easy walking distance, if you don’t mind walking in the ditch or right next to the traffic. Houston is not big on pedestrian traffic, so no sidewalks for you!

It’s not a direction I go very often. But it used to be a place to pick up day laborers. I’m not so sure anymore. ICE activity may have scared them away. 

Which got me to thinking: we have a lot of brown people here in the fourth largest city in the country. But I’m not hearing a lot about ICE raids. Not that they aren’t happening, I’m sure. But ICE hasn’t raided the parking lot of either Home Depot near me. They haven’t grabbed people precious to the community. If ICE has gone over the top in a Texas city, it hasn’t caught much attention yet. 

I know ICE is working in Texas. But I wonder if they’re being focused on red states, the better to justify their righteous indignation at angry citizens. The mayor of Houston might stand up for people against military ICE tactics (after putting his wet finger in the air), and Abbott would surely cheer for ICE over “illegals,” but any pushback (and there would be some if the circumstances were right) would embarrass the shit out of Trump.

Trump prefers a punching bag.

I don’t doubt he’s doing this for the publicity (Miller wants his Reichstag, but Trump just wants his bully pulpit). But he hasn’t sent the Marines to LA yet. I think he’d rather complain about Newsom than take responsibility for whatever errors the Marines might make. (Or just the responsibility for invoking the Insurrection Act. And it’s notable Trump didn’t take Newsom’s bait and respond to his “stone cold liar” remark. What could Trump do? Send in the Marines? But he ignored it and said Homan can arrest Newsom if he wants to. Of course, Homan has no such authority, and Habba is not the U.S. attorney in California.).

Trump is using this to keep MAGA rallied, especially as they aren’t all excited by the BBB. Trump doesn’t understand governance. He only understands marketing.

He’ll, he’s already declared victory.

ABC News Suspends Gavin Newsom

There’s no working with the President. There’s only working for him. I will never work for Trump
Newsom: I think it’s something much more. This is about authoritarian tendencies. This about command and control. This is about power. This about ego. This is a consistent pattern.. this guy has abandoned the core principles of this great democracy.

He’s threatening to go after judges he disagrees with, cut off funding to institutions of higher learning, he’s rewriting history and censoring historical facts.
Newsom: They’re trying to incite violence. They’re trying to impose the kind of rhetoric that only makes conditions worse—that, quite literally, puts people’s lives at risk.

And they’re doing it intentionally and knowingly.

Especially since the POTUS isn’t really good in a crisis. Does he think it’s another Covid outbreak? 😷

Better Responses

They've already lost. One Home Depot raid and they had to FEDERALIZE the guard when 100 unarmed neighbors protested? This regime is in trouble. Big trouble.
And another thing:
I’m seeing all these debates here about whether violence can be justified in some circumstances. That’s not helpful. It is beside the point. This is a battle over legitimacy and the field of that battle is public opinion. This is a flagrant abuse of power. It is a crisis entirely of the Presidents..

2/ making. He created the crisis and now he’s trying to exploit it. This is an attack on the self government and sovereignty of the state of California which has all the tools it needs to maintain civil order. Everyone has the right to protest this brazen abuse of power. Any acts of violence …

3/ just play into Trumps hands. And this comment isn’t directed to the people who were the protesting today and yesterday, the vast majority of whom as far as I can tell were doing so peacefully. It’s directed at people here encouraging acts of violence.
All very sound, but if you’re going to worry about “acts of violence,” again, take a lesson from Kent State 1970.

The violence there came entirely from the NG troopers. They justified it later because “Those to whom violence is done/Do violence in return.” And consider themselves in the right. Except the NG started it with the tear gas. Just like ICE did in LA. And ICE used flash bangs, apparently against themselves as much as against the protesters. And when all else failed they rammed protesters with a vehicle. And wore their masks and their military-law enforcement cosplay gear, because that makes them fearsome. And they still had to be saved by the Sheriff’s deputies and the NG.

Pointing and laughing are the rule of the day. 

Trump/Miller/Hegseth want to say this was a violent uprising? Trump went to the UFC, Miller and Hegseth were on the other side of the continent. And the LAPD called the whole thing “peaceful.”

Pointing and laughing is very definitely in order. This is not the Reichstag we’ve been promised. This is little boys with little dicks thinking this is how men behave.
Cannot stress enough that this is a pitiful action by a weak, scared, pathetic group of insecure, wannabe authoritarians, and they should be mocked until the end of time for wanting to bring in the military over some people protesting them at a Home Depot.
Feed them nothing but mockery. 

Things That Didn’t Happen For $1000

Call ICE The Gestapo Hat:
Bad shit happens when the military comes into to a volatile situation. This reminds me of a story from the 1992 riots in Los Angeles, to which some Marines deployed. I knew one of them and he told this story I also saw elsewhere — absent his telling it I would have assumed it was apocryphal.

/2 So the Marines were deployed with the LAPD in various neighborhoods where there was still unrest — real unrest, not the largely peaceful demonstrations we’re seeing now that the feds are lying about. They were sent to give support to the cops against people with guns.

/3 There’s a couple of desultory snipers in a building and the cops want to go in. (Apparently the snipers had shotguns, which are not really great sniper weapons). One of the cops tells the detachment of Marines “cover me” as he prepares to rush the building.

/4 So “cover me” to the LAPD means “if someone pops up with a gun and shoots at me, shoot at them.” Apparently to the Marines it means “lay down a curtain of suppressive fire using your rifles.” Hilarity ensued.
1992 was the last time the Insurrection Act was invoked. And my memory stretches back to when the National Guard, without Presidential authorization or facing an out of control situation, “laid down suppressing fire using [their] rifles.” And blamed it on the protesters throwing tear gas canisters back at them. Funny how that always justifies official violence.

The students at Kent State were no more threatening the lives of National Guard soldiers than the protesters in LA were threatening the lives of ICE agents.

From TV reports (via Acyn), the few fires yesterday around ICE and the federal detention center were small, brief, and inadvertently started by ICE “crowd control” efforts (flash bangs, mostly). And all were quickly extinguished, even the burning car (so, it wasn’t a Tesla). Extinguished by the protesters.

Trump, early this morning, never mentions calling in the Marines. That was Hegseth losing his shit, which is cold comfort, indeed. Trump praises the NG for saving the day, but from accounts on the ground that was the Sheriff’s Department clearing the way so NG vehicles could drive in and carry the hapless ICE agents out. Seven hours ago from when I write the “riot “ was already over. The usual suspects are declaring this a “Reichstag Fire”:
Mostly so they can say: “See? I was right!” I think that crowd needs Trump and Miller as much as the latter needs them.

Yes, Trump is declaring all protesters who wear masks (what the fuck is it with these people and masks?) are unmutual. He might as well be carried down to the sea in a chair and tell the tides not to come in.

That would be the proper metaphor for his administration. You want to do him political damage? Mock him. Quit raising the threat level for him. He can’t do it himself. Why help him?

Small penis energy from a federal government agency. Especially that “life long consequences will follow!” Really? Especially after ICE agents rammed a car through a group of protestors? Where does ICE get the authority to run people down on the streets?

Even the Sheriff’s Department used rubber bullets, not vehicles. And rubber bullets are bad enough.
Trust Trump to escalate this to Black Watch Plaid. Trump also needs to learn the story of the boy who cried “WOLF!” Calling out the Marines for people protesting in the streets? Yeah; that’s not gonna have consequences….

Further, I direct and delegate actions as necessary for the Secretary of Defense to coordinate with the Governors of the States and the National Guard Bureau in identifying and ordering into Federal service the appropriate members and units of the National Guard under this authority. The members and units of the National Guard called into Federal service shall be at least 2,000 National Guard personnel and the duration of duty shall be for 60 days or at the discretion of the Secretary of Defense. In addition, the Secretary of Defense may employ any other members of the regular Armed Forces as necessary to augment and support the protection of Federal functions and property in any number determined appropriate in his discretion.
Which is where this gets stupid.
"Rioters and looters”? Take a deep breath there, Jackboot Jim.  Even those words don’t allow you to invoke the Insurrection Act or violate 18 USC 1385.

If Hegseth doesn’t know that, I expect the Marines and their commanders do:
Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.
Yes, Trump could pardon them. But that would be the turd in the national punch bowl.  And do Marines want to be in the position of needing mass pardons? Especially since accepting a pardon is accepting guilt for the crime?

No, it’s not neat and tidy. But it just gets messier and messier.  ETTD.

As for the Insurrection Act (10 USC 251-255), even Trump seems to understand (so fat) that a day of protest around a building in LA doesn’t exactly fit even the vague language of the law:
Section 253 has two parts. The first allows the president to use the military in a state to suppress “any insurrection, domestic violence, unlawful combination, or conspiracy” that “so hinders the execution of the laws” that any portion of the state’s inhabitants are deprived of a constitutional right and state authorities are unable or unwilling to protect that right. Presidents Dwight D. Eisenhower and John F. Kennedy relied on this provision to deploy troops to desegregate schools in the South after the Supreme Court’s landmark decision in Brown v. Board of Education.

The second part of Section 253 permits the president to deploy troops to suppress “any insurrection, domestic violence, unlawful combination, or conspiracy” in a state that “opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.” This provision is so bafflingly broad that it cannot possibly mean what it says, or else it authorizes the president to use the military against any two people conspiring to break federal law.
Yes, section 253 could be used the way the Brennan Center says, but that would be using a sledgehammer (or a thermonuclear device) to swat a fly. Even Trump isn’t going to try that. Not unless LA turns into Seattle in his first term. And there’s no indication that’s going to happen.

The likeliest outcome is that Miller shouts some more about “insurrections” and Trump declares his mighty authority chased the elephants away, and very little else happens.  Trump is just going to remind people of how he cleared people (violently) from the streets so he could hold up a Bible. He’s not going to cover himself with glory, especially a week before his birthday party. No, he won’t see that; but half the pleasure of schadenfreude is seeing what the victim can’t see.

For the rest, this is the problem when you elect a man-child because you don’t like your economic circumstances.
There. That’s the reality. Trump can’t keep everybody thinking a few blocks of LA is the entire state of California. Or a threat to the Union. Besides, Trump was so worried, he went to the UFC tonight: You can’t play the guy too tough to go to the Situation Room, and simultaneously say the republic is so endangered and federal power was so thwarted in LA that even the National Guard is not enough.

And Trump has now admitted that he gave access to high level government secrets to a man he believes to be a big time drug addict.

I'm sorry, as much as I am enjoying this spat, how can you take seriously someone who spent 100s of millions of dollars electing Trump, then went to work for Trump, left government just days ago praising Trump, and is now calling for Trump's impeachment.

I think they already figured that out, because this is already turning into the summer of our discontent. Now with more stormtroopers! Stephen Miller says only wimps call out the National Guard. There is a livestream here.  ICE is out of control and LAPD/Sheriff are refusing to get them out of the mess they made.

Basically, ICE handled this as poorly as possible, and LAPD just tried to keep it contained. But they left ICE to clean up their mess. It seems ICE did need the National Guard to rescue them. And the Sheriff’s Department to let the NG in to get ICE out.

He got in there and the message was, 'I don't really care all that much'."

Abrego Garcia was stopped in Tennessee for speeding and “being unable to maintain his lane.” I mention this because that puts venue there, which is why the resignation of the head of the DOJ criminal division the day the indictment of Abrego Garcia was released, is so significant.

You will note, at that link, that the indictment says Garcia did not reveal he had been in Texas before driving through Tennessee. But the DHS referral report says Abrego Garcia told the officer he’d been driving from Texas for three days (apparently to explain his erratic driving). 

Sounds a lot like somebody hid information from the grand jury, the better to indict that ham sandwich.

Update: I didn’t pay attention to the date of Schrader’s announcement. It was two weeks ago, or May 21, 2025. The day the Ábrego Garcia indictment was handed down.

Every Desperate Accusation Is A Sad, Sad Confession

Like this: But Stephen Miller can’t stand very much reality, so:
And then guess what? After he does hard time in an American jail, guess where he is going? Right back to El Salvador.

What do Democrats have to say about this now? They celebrated this guy, they worshipped this guy, they treated him as a hero.

Now he has been indicted by a grand jury for committing some of the most heinous crimes I have ever read about. He will do hard time in our jails and then he is going back home where he belongs to El Salvador.
No, he’s not a prosecutor or a DOJ official. But he’s a government official, the White House Deputy Chief of Staff. He really needs to learn to shut up, because now he’s another brick in the wall of Abrego Garcia’s defense.

These people really are their own worst enemies. Not unlike this:
I mean, these people literally don’t know what they’re doing. Which is my riposte to every “serious thinker” yes, including Ms. Ben-Ghiat) who think America is about to be Nazi Germany redux. These clowns are only a danger to themselves.

Do you mean explaining that the Constitution applies to people, not only citizens? I’ll take that burden all day.

As someone else explained in the context of birthright citizenship, if “persons” only means “citizens,” then the law can’t apply to anyone in the country who is not a citizen. As birthright citizenship does not apply to diplomats and pregnant family members (or pregnant diplomats). And if the law does not apply to non-citizen persons, then they cannot be arrested or detained or forcibly deported.
