Opening The 1960’s Time Capsule

And there’s Ol’ Rip Bull Connor, alive and well.

He means like this guy. Because Ma and Pa America should know better than to be in the vicinity of anarchists and agitators. Listen to Bull; he knows. Pretty much what Bull would have said. Welp, he just threw that case out. (Not strictly, but he just became our man on their side.) Is he getting off on this? He’s getting off on this, isn’t he? THIS. IS. NOT. A. CRIME. Nor are Frey and Walz anarchists or agitators. Neither of which category is criminal.
Justice Kavanaugh, we salute you. 🫡 And hope one day to replace you with a bag of bricks. It would be smarter. Alternatively, we hope to make you an object lesson on why Congress should make the Justices ride their circuits again, and get out of their ivory tower and into a trial court again. You want lifetime tenure? You got it. And maybe we should have you ride the circuit on horseback. The fresh air will do you good. Or convince you to retire and stop acting like Mandarins.

  1. I sort of like the idea of issuing each Justice a Winnebago motorhome and sending them off to set up shop in Walmart parking lots to hear cases. I bet it would drive Roberts and Alito, in particular, nuts. I think the rest of the R judges understand and accept their hackdom, but those two have themselves set up a peg or five too high.

    1. It’s historical, not aspirational. Congress has full authority under Art. III to do it again. I seriously think it might solve some problems, especially the willingness to stay on the bench until you’re carried out feet first.

  2. I wasn't aspiring so much as legislating, actually. "MAJA- Make All Judges Active" or some such. I agree, putting the Justices on the road for months would dial back some of the prestige to which they have become addicted.

  3. The intertoobs are a murky mess. It’s never clear what’s reliably known, and what isn’t.
