A) Professor Vladeck is right, the Insurrection Act needs to be modified.

B) Even Trump never tried to use the Insurrection Act

C) “I thought the President was gonna deputize me!” is not a criminal defense. If anything, the lawyer has admitted the intent element of the crime. Not for the purposes of the trial, but you don’t want your lawyer talking like that about your case in public.
