Biden can make the EO, and the Freedom Caucus (or somebody; doesn't matter who) can go to D.C. court and sue, and chase it up to the Supremes. Who among us is sure how they'd handle this hot potato?
It's the uncertainty that's the problem; now, and until the debt ceiling is lifted. Is it lifted if Biden says so? Nobody knows.
Aye, there's the rub.
It's the "What if...?"
Personally, I'd rather bank on 5 GOP House members who don't want to ruin the world economy and flush America's economy down the toilet. Sure, if on the deadline drop dead moment they can't be found, call in the 14th Amendment. But before that?
Don't let Congress off the hook. Ever. This is their Constitutional duty, too. The Constitution is not upheld just by the Executive.
