The five panel appellate court divided on remanding to the trial court for rehearing on the damages, some arguing a sitting President couldn’t be dragged into civil court. Whatever the Court of Appeals does, the issue of damages is the live issue. I think anyone is in their rights to believe that this is yet another time that the judiciary has let Trump get away with being a crook and law breaker whatever the customs of that bizarre tribal culture are. They've been doing it his entire life and that's what produced his regime.
ReplyDeleteThis is a step along the way. If the decision is upheld, due process requires the state get a chance to retry the damages issue in the trial court. Trump doesn’t have immunity from civil actions, even as a sitting POTUS. If he did, I don’t know why that wouldn’t stall the appeal of this decision, too.
