Actually, Haven’t Slept Better In Weeks

A picture is still worth 1000 words. 3 pictures? 38 counts of an indictment. I’m noting McCarthy’s tweet is, as I post, 17 hours old. The indictment and the Jack Smith press conference are still reverberating.”Life comes at you fast.”

Besides, the threat of Gym Jordan’s committee is just bluster. No court in the land (double for the D.C. circuit) will allow any Congressional interference with a criminal prosecution. Consider what they are not doing to Bragg’s case. Same thing here.
There was that; yesterday. Now:
The Post is reporting, "The indictment unsealed Friday rattled some of his advisers, who were not aware of the granular evidence obtained by the Justice Department, according to people familiar with the matter," before adding, "Two people said the evidence was more damning than they expected, and could have been avoided if Trump would have just listened to his lawyers and advisers."
And this is helpful framing: The ground beneath their feet is getting smaller and smaller. The trial (Smith said he wants it in August. Reports are SDFL is known for its “rocket docket.” emptywheel says that’s impossible, that  the CIPA process (protecting classified documents at trial) will take 6 months. But that assumes competent counsel, and Trump is more averse to them than he is to the truth). I’ve seen a federal judge reduce a three week trial to 5 days, so never doubt the power of a federal judge over their docket.) And the trial won’t be a MAGA circus, either.

McCarthy and Briggs & Co. are children in a sandbox. (Jordan’s tweeted response to the announcement of charges was, by contrast, muted. Has his said a word about the indictment?). They are playing and throwing tantrums.

Jack Smith is not. And he has the full force of the U.S. government behind him. McCarthy & Co. know full well that they do not. Not when it comes to criminal trials.
