Yes, and then the court ruled that the privilege is controlled by Biden. (Aside from the question of whether the privilege is being used to conceal a crime, which obviates the privilege.) That Trump doesn’t want to acknowledge that doesn’t mean there is still a privilege to waive.

Twitter is not suing to force the purchase. It’s suing to enforce the penalty clause for pulling out. Musk has declared Twitter in material breach, which negates the purchase contract. Twitter is suing Musk for breach of the contract. The court can’t force Musk to perform on the contract, but it can enforce the penalty provision. But first it has to figure out who’s in breach of the contract.

Which, as I said, is actually what Twitter is suing for.
