And The Interesting Story Du Jour Is…

Color me jaundiced, but racism has been the “bridge too far” for the Court since at least the Warren Court. Like fraud in torts, it is so pernicious it undoes everything it touches. But fraud is easier to find, because racism is still very much in the eye of white beholders; who can be very selective in seeing it in the system. The system they are still very much in control of. But “systemic racism” is bunk, right?

So this is a victory. But it’s almost a Pyrrhic one. The VRA hasn’t (yet) been totally gutted. But the 15th Amendment is still more honored in the breach than in the keeping. And racism in law is still a matter of when white people say it’s there; or that it’s a problem.
