Notably, Paschall indicated that if Chansley’s effort were successful, it wouldn’t result in the dismissal of the case against him altogether.
“Rather, Chansley’s guilty plea would be withdrawn, the charges in the indictment would be reinstated, and the case would proceed to trial — where Chansley, if convicted, could face up to 20 years’ imprisonment,” she wrote. “Chansley, therefore, may wish to consider whether the “relief” that he could obtain through these claims is truly preferable to preserving the benefits of the Plea Agreement.”The context here is that Judge Lambeth’s sentence was based in Chansley’s professed “regret” for what he did.
Of course, Chansley is now saying he regrets nothing and would do it all again. And based on 2 minutes of video taken out of context by Tucker Carlson (no, I’m not kidding), he wants to walk back into the lion’s den. And what’s he going to get for his troubles?
The level of legal incompetence on display, from Trump’s lawyers down to the QAnon Shaman, is really quite stunning. I’ve never practiced criminal law and I would tell Chansley this is something I wouldn’t take to court if I were his appointed counsel.
