I can't remember which Constitutional scholar it was who, when someone called the Dersh one in his presence he laughed and said about the only thing he knew was how to play to a jury to get wife killers off.
I don't know what Giuliani's been drinking, but apparently he's been sharing it with Dersh.
Odd how forty years ago he was considered a leading civil libertarian. But his area was always Criminal Law rather than Constitutional Law. In the standard compartmentalization there was, of course, a hefty dose of constitutional law in the areas of self-incrimination, searches and seizures, cruel and unusual punishments--i.e., the fourth, fifth and eighth amendments. Executive power under Article II, impeachment and the co-equal powers of the three branches is more the focus of those who teach Constitutional Law courses.
What is most disturbing is not that Dersh is sounding like a criminal defense attorney--that's what he is, after all, and a criminal defense attorney often is pushed to making crazy arguments from his duty to defend--but that congressional Republicans are taking the same role.
The Republicans don't seem constrained by the law or a judge, the two great boundaries of a lawyer's argument. And they aren't, of course, which is another problem.
I agree about Dershowitz, but who is his client here? He seems completely unhinged and addicted to the attention he can get.
