Deutsche Bank statement on U.S. Supreme Court ruling:— Travis Akers (@travisakers) July 9, 2020
“Deutsche Bank has demonstrated full respect for the U.S. legal process and remained neutral throughout these proceedings. We will of course abide by a final decision by the courts.”
Just pointing out the bottom tweet doesn't say what the top tweet says.
All Deutsche Bank is doing is agreeing to abide by a "final ruling" of the court. But that's why the Supreme Court sent this case back to the trial court: because there was no final ruling being appealed. It was an interlocutory appeal. Which means Laurence Tribe is right:
The Vance case should be expedited in the lower courts. If the Nixon tapes case could be decided in three months and Bush v. Gore could be decided in one month, this really should not drag out beyond the November election.— Laurence Tribe (@tribelaw) July 9, 2020
But unless the trial court gets its ducks in a row, it could commit reversible error the Appellate court couldn't ignore. Still, this can move expeditiously, unless the Supremes decide on appeal there are new grounds to review and settle (I don't even know what they added to the Appellate opinion, actually. Maybe something on the merits of Trump's argument, certainly nothing on the outcome.).
Besides:
And Trump will continue freaking out about it on Twitter, extending the news cycle around it https://t.co/rD6zMXjvrk— Maggie Haberman (@maggieNYT) July 9, 2020
So it's the gift that keeps on giving.
If the Supremes accept another appeal, and accept a stay while the matter is on appeal, nothing final could possibly be decided until this time next year. There are still some games to be played, and honestly I don't think Trump's tax returns will drive his approval rating down any more than it's gone already (if Mary Trump's book doesn't do it, or Bolton's, what will? The "grab 'em" tape didn't make any difference 4 years ago.). Eventually, though, he's going to face criminal charges in New York. Moving to Florida won't obviate that a bit.
Like the mills of God, the mills of justice grind slowly; but they also grind exceeding fine.
Adding:
So he's kicked it past Election Day. If he wins he just keeps it up. Or goes with the Andrew Jackson option: "Justice Marshall has made his decision; let him enforce it." If he loses, we'll be too busy putting out fires to have any real stomach to pursue him personally.I really think the State of New York will still have the stomach for it. I don't think Biden's DOJ is going to be much interested in Trump's tax returns, but there are other matters they may find more compelling.
Whatever D.C. does, Trump will always have the Manhattan D.A.
This is a tremendous victory for our nation’s system of justice and its founding principle that no one – not even a president – is above the law. https://t.co/jVm15aph7s— Cyrus Vance, Jr. (@ManhattanDA) July 9, 2020

ReplyDeleteSad but probably true. It's almost beyond belief that Trump had a "school," Trump University, closed down as a fraud during his campaign, and a "charity," the Trump Foundation, closed down as a fraud during his term, and those enormities apparently had no discernable impact on his reputation.
