Legal literacy matters. And this story is legally illiterate from the outset. It continues the journalistic (mal)practice of cleaning up what Trump actually says/does.Federal appeals court panel rejects Trump request to block certification of Pennsylvania’s election results https://t.co/gPFf8Telaw
— The Washington Post (@washingtonpost) November 28, 2020
The story claims Trump appealed to block certification of PA’s vote. That would be the reasonable thing to do, but it’s not what Trump’s lawyers did. The opening paragraphs of the opinion make clear what was appealed: only the ability to file a third amended complaint. I know that’s a bit inside baseball, but that’s what they did. They should have asked to block certification of the vote. They didn’t.
Really, trying to make Trump make sense does a disservice to truth and to the American people.
