I was assured by earnest lawyers on MSNBC this morning that SDNY and Alvin Bragg had screwed this up.

Merchan to Blanche: "You are literally accusing the Manhattan DA's Office and the people assigned to this case of prosecutorial misconduct...and you don't have a single [case] citation to support that allegation that the USAO is under the DA's control."

Merchan has asked Blanche why he/Trump didn't raise these allegedly missing documents as an issue back on February 15th when the parties were in court and Blanche was asking for a trial continuance.

Blanche appears frazzled.

Justice Merchan asks why Trump did not raise this issue during the last hearing on Feb. 15.

Blanche says "the process was ongoing" at that time.

The Touhy request was denied at that time, he said.

This is where the MSNBC lawyers didn’t know the facts:

Justice Merchan:

"That you don't have a case right now is really disconcerting."

"You're literally accusing the District Attorney's office and the people in it of prosecutorial misconduct — and me of being complicit in it."

He asks whether Blanche has a citation for that.

This is not how you win cases and favorably influence judges.

The defense filed the first subpoena earlier this year — and the latest on March 20.

Merchan: "Why didn’t you do it in June or July?"

Todd Blanche says it wasn't the defense's job.

Merchan: "It's not the People's job, either."
