During an interview with ABC News’ “The Investigation” podcast on Tuesday, Sanders said the White House has made no official moves to block Mueller from appearing before the House Judiciary Committee — which is tentatively set for May 15 — but said it will be discussed at some point.
“I think that’s a determination to be made at this point,” she told ABC. “[Trump’s tweets are] the President’s feeling on the matter and the reason is because we consider this as a case closed as a finished process.”
Trump tweeted over the weekend, appearing to advise the Justice Department that Mueller “should not testify,” but the White House has waffled on whether it intends to actually keep that from happening.
The NYT article mentioned in the tweet above pointed out that Mueller's term as a DOJ employee is temporary (he came out of retirement, let us recall) and ends this month.
So if Trump wants to block Mueller from testifying to the House, he can only conceivably do so until May 31. After that, Mueller is a private citizen, and Trump has no control over him whatsoever.
And honestly, at some point this becomes Nixon's Saturday Night Massacre over a term of weeks, not hours. People want to hear from Mueller. Attempts to block his testimony in perpetuity won't win friends for Trump. Even his staff understand that. All of his efforts to delay investigations is going to crumble, too. As I said, Presidents get preference, and conflicts between the President and Congress tend to get resolved in courts rather quickly (less quickly if it's just the Administration, perhaps; but involving POTUS raises the stakes significantly). If Nixon could have delayed things in court, he'd have served out his second term. The Supremes didn't let that happen.
I don't think they will now, either. Whether they move to save Trump, or preserve the rule of law, I don't think they will dawdle. (If you can't tell, I'm getting tired of all the "Hulk SMASH!" advice being given to Democrats by on-line noobs who have never run a political campaign for dog catcher. The mills of God grind slowly, but they grind exceeding fine. The mills of justice aren't too rapid, either; but they tend to get the job done.)
