The appeal is a little late to come up with arguments you didn’t present to the trial court.

Thus is where I remind you that Garland was an appellate court judge for over a decade (though I doubt he’s deeply involved in the case, he’s a helluva resource), and DOJ has lawyers who do nothing but appellate work. And Trump’s lawyers are just: not good.
