The denial of the motion doesn't surprise me. This, however, does:

In a letter filed early Monday morning, Trump attorney Joe Tacopina claimed the "Court has mischaracterized the facts of this case to the jury."

"Here, despite the fact trial testimony has been underway for only two days, the proceedings are already replete with numerous explains of Defendant's unfair treatment by the Court, most of which has been witnessed by the Jury," the letter said.

"Numerous explains"?  I know that basic literacy is not grounds for incompetence of counsel, but:  "numerous explains"?

I think Tacopino is taking the "My Cousin Vinnie" comparisons too much to heart.

What does surprise me, is this:

Again, not the denial of the motion, but the continuation of the same losing cross-examination strategy he had last week.

Because it's going about that well.  Tacopino should either have changed tactics or cut his losses and sat down.  At this point he just has a shovel and he's determined to dig that hole.
