Which means he knows the Constitution of the United States states the law.
And the Declaration of Independence is an historical document which states the grievances of the colonists against England in the 18th century. Its principles led to war. That war established the United States of America (eventually). And 13 years after the Declaration, the ratified Constitution established the government of those United States.
See the difference now? Nothing in the Constitution adopted Jefferson’s argument from the Declaration.
John Eastman is a dangerous crackpot who nonetheless has a constitutionally protected right to his crackpot opinions. But when he goes to put them into action, it’s not a defense to criminal charges.
I mean, Art I, Sec 8: "To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections..."
