Now he just needs a lawyer:
Rudy says the first order of business is to get his case removed to federal court under the theory that he was either a "federal employee" at the time or serving as an "agent" of a federal employee. He says he disagrees with Alan Dershowitz who said last night that Rudy doesn't meet the legal criteria.
Rudy then says he will file a Motion to Dismiss in federal court relying on Justice Robert Jackson's dissent in a 1944 case discussing dismissals for violation of due process.
Rudy said he understands that he will have a difficult time convincing other lawyers to adopt this strategy and go along with it. He says that even if it doesn't work it will get a lot of publicity and garner public opinion to their cause.
