A conviction can be overturned on appeal if a defendant can show that he didn’t understand his right to testify at a criminal trial. It is common for a judge to now question the defendant directly about his understanding of his right to testify which Merchan should do now.

Since Todd Blanche nodded his head yes when Trump claimed that his right to testify has been taken away because of the gag order, Merchan must start the day tomorrow inquiring of Trump’s understanding AND whether Blanche misadvised him on his 5th Amendment rights.

I’m tired of people with opinions telling Justice Merchan what he has to do, but it will be interesting if he thinks he has to question Trump on the point.Todd Blanche nodding his head to Trump’s statement that he can’t testify because of the gag order is a very serious ethical violation in the middle of a criminal trial. Merchan must absolutely grill Blanche and get to the bottom of why he lied to his client about his rights.

I love how Legal Twitter and the TV Punditocracy act as though Justice Merchan and the prosecutors fell out of a coconut tree, as though they haven't been very intentional in doing everything they can to avoid appealable error.
