The Supreme Court is going to decide the most crucial case of the term:Short answer: until the 1924 law, native Americans were considered to be under tribal jurisdiction, and so exempt from the first clause of the 14th. That analysis was peculiar to the status of tribes as sovereign on American soil (which status I cannot properly explain further. I know there are people here who can.). Now they have dual citizenship at birth, which cleared up that problem.

The answer is clearly no.
They are not “subject to the jurisdiction of the United States,” as required by the 14th Amendment.
Let’s see if the justices have the courage to follow the plain language, original public understanding, and 127-year-old precedent.
Answer this dispositive question:
If the children of American Indians did not get birthright citizenship under the 14th Amendment (Congress gave them statutory birthright citizenship in 1924), how the hell would illegal aliens?
They don’t.
This is a very bright red line.
“Illegal aliens” are “subject to the jurisdiction of the United States,” otherwise they would be “outlaw,” a pernicious condition that has never been recognized by American jurisprudence. Their status has nothing to do with the status of tribal members.
Smart money says the Court will affirm the reasoning of Wong Kim Ark (which Davis never references, because it addresses the very argument he’s trying to make. He loses.) His stupidity is not worth further effort. Davis is just an ignorant boob.
And he was on Trump’s list for AG. đ€Š♂️ Maybe we want to keep Bondi around. It can always get worse….
Wouldn't it be funny if all of them got deported back to Eastern Europe except Tiffany. Only that's not who they'll mean when they revoke citizenship. Hey, they've overturned so much of the 14th Amendment, why not that part?
