 So, what's the legal theory here?  That there is "damage" to the restored pool work that was not caused by poor installation, and since Hearne was seen putting his hand somewhere in the 338,676 square feet of the pool, he caused that damage? Where ever and whatever it is?

That's not how this works.  That's not how any of this works.  In fact, that's why charges were dismissed in the first place. So sure, let’s try again! 🤦‍♂️
