And after several months in court, it ends up on appeal to the Supremes, who decide it's so late in the term they'll docket it for arguments in October, 2020; at the earliest. At this point, that's perfectly conceivable.
Better is to call them as witnesses in the Senate trial. Doesn't matter if they surprise you, or try to; they're under oath and locked in by other sworn testimony, and they can't tie it up in Court: the Chief Justice is there ruling on any privilege questions (unless they want to plead the 5th). There is no appeal from a Senate trial on impeachment, and so no appeal from the ruling of the presiding Chief Justice on questions of privilege. One way or the other, the question is answered.
