🌀 Climate Change Is Fake News

NBC News:
Helene, a post-tropical cyclone, was expected to stall over the Tennessee Valley through the weekend, and could bring an additional 1 to 2 inches of rain across parts of the Ohio Valley. 
At least 42 deaths have been reported as a result of the storm, which made landfall Thursday night in Florida's Big Bend region as a Category 4 hurricane. 
More than 3.8 million customers are without power in states stretching from Florida to Ohio. 
Officials warned of an imminent breach of a dam in Greene County, Tenn., on the border with North Carolina, and told residents downstream to move to higher ground immediately.

Trump Finishes Up Quick

He used that line, verbatim, earlier this week. How does he do it? No clue how basic ideas like venue, jurisdiction, and reasonable suspicion, work.
"The people that you see leaving?" Trump said. "Nobody ever leaves. And when they do, I finish up quick."
I guess that's why he ended after an hour. Or they thought Kamala was going to confiscate their cars in the parking lot.

Um, Yes…Um, No

Well, it provides an opening for a discussion of why Adams is treated differently than Thomas. And an enforceable ethics code is part of it. I would not want to be the prosecutor trying to prove bribery charges against Clarence Thomas for changing his judicial philosophy or position based on money received from a right winger like Harlan Crow. Who, according to public accounts (ProPublica), basically bribed Thomas to stay ON the Court. Because he wanted Thomas to keep doing what he was doing.

There’s a much stronger conflict of interest case there, on any case involving Crow’s interests. Although I think what Crow is mostly interested in, is culture war issues. And Nazi memorabilia.

The better target is ethics violations, especially those that bind federal judges. But the Supremes have rigged the system. On their own authority they have declared themselves appointed for life. They are not subject to mandatory retirement from the bench, as the lower courts are. They can only be removed by impeachment, and since they are the Supremes, they don’t recognize the authority of any judicial body or ethical rules except those they promulgate. And they haven’t presented any. And if they did, who would enforce them, except the other 8? 

Congress does the same, by Constitutional design. But no one in Congress is elected for life.

Whether they would recognize the authority of Congress to impose some on them is an interesting question; especially if they wouldn’t. They are an Art. III court, expressly subject to the Congress (who can set their number, jurisdiction, even length of term). How far would the Supremes go to declare themselves equal to the first and Second Articles, and so implicitly superior? (They decide what the laws mean and what laws apply to them. If that ain’t superior, what is?)

And what if Thomas was convicted, but the Senate refused to remove him? Most Justices have stepped down in face of a threat of investigation. What if Thomas doesn’t?

So, yes, we need a set of ethical rules for the Supreme Court. But we also need a well thought out enforcement system, and a system for retirement from the bench the rest of the Federal bench has to follow. “Supreme” is a Constitutional title, not an existential expression of being.

Same Question As Before

Amarillo is going to decide in November whether or not to “ban” people from traveling through their city on the way to New Mexico for an abortion.

How this would work is anybody’s guess. Unless the woman is in the last trimester, it won’t necessarily be obvious she’s pregnant. And asking her where she’s going, and why, won’t be any police officer’s damned business. And unless they’re planning to post police officers at the restaurants, hotel lobbies, and gas stations around town, to keep a sharp eye out for traveling females, what’s the idea here? Moral superiority?

I’ve been through Amarillo more than a few times. They could use the business from travelers going to New Mexico. There are casinos in New Mexico, on Native American reservations. I doubt it bothers the good citizens of Amarillo that people are using their streets, restaurants, and hotels (there ain’t a lot between Amarillo and Santa Fe or Albuquerque to stop at) on the way to gambling, which is also illegal in Texas. In fact, I imagine those local service industries count on it. I’m pretty sure there are billboards in the city advertising the casinos only a few hours away. There are direct benefits in Amarillo to gambling that don’t seem to bother the upright citizens of that city one bit.

So the empty and vaguely moralistic gesture to ban travelers who may be seeking an abortion seems entirely ungrounded in legal or ethical theory to me.

I understand that if I commit a crime in Illinois, and return to Texas, I can be extradited to Illinois. But what’s the legal theory that says I can be prosecuted in Texas for traveling to Nevada to gamble? Or just driving to Louisiana to go to the casinos that advertise in Houston?
