And how a little knowledge is a dangerous thing. (The fundamental problem with both of these arguments is that the states determine, by law not whim or political party, how electors are chosen. But once that process is followed, i.e., according to law, it can’t be undone by the legislature(s). The law at the time of the election must prevail.
So the “fake” electors were truly fake, having not been appointed according to state law. Using them to force the issue back to the states did not cleverly implement the 12th amendment, it simply violated state laws. Some of Trump’s lawyers were not nearly as clever as they thought they were (they were pretty much banking on “treason” prospering so no one could complain; or the Court taking up the matter, and at worst they advanced a losing legal theory. As it stands, they got door number three, the one with the tiger. π
