The President Knows More Than We Do

WELKER: Are you seriously looking at invoking the Insurrection Act?

VANCE: The president is looking at all of his options, right now he hasn't felt he needed to. But we have to remember we are talking about this because crime has gotten out of control in our cities

WELKER: Crime is down in both Chicago and Portland

VANCE: Crime is down in Chicago and Portland often because they are so overwhelmed at the local level they are not even keeping the statistics properly
This is what happens when you give a narcissist sociopath with no interest in governance the presumption of regularity.

The 7th Circuit followed the 9th Circuit because the 7th doesn’t want to be the first one to stick its neck that far out. But the 9th said the government failed to appeal the deployment decision. The 7th didn’t have that issue, but upheld the denial of deployment anyway.

This is the way courts slowly change the presumptions that are being used for injustice. With a bang that sounds like a whimper.

Facts on the ground notwithstanding, does the Insurrection Act really contemplate run-of-the-mill crime as a reason to invoke?

    1. No. And I’m not sure leaving it to the secret knowledge of the President is enough, either.

BTW, there is no provision for “martial law” in the Constitution. That’s what the Insurrection Act is for, and it doesn’t create martial law.
