One under appreciated problem here is that ICE destroyed the crime scene. They hustled the shooter into a van and, rather than tape off the scene for an investigation, cleared it. Forensic evidence is gone. There’s enough of a struggle prosecuting a federal agent for a state crime. The Feds are doing everything they can to make a prosecution impossible.
