Watch the donut, not the hole


The suit doesn't ask for any kind of "prior restraint" or block on the publication of the book (except long after the fact, because there is no request for extraordinary relief), and yet the White House is happy for that to continue to be the narrative.  Despite claims it has "classified information," nothing in the filing seeks protection against release of the book (except by final judgement against Bolton, and direction to him to stop the publisher).  Publication is scheduled for next Tuesday.   If DOJ is going to seek a TRO, they'd better get on it (although I still think NYT v. Sullivan means they won't get it).

And the lawyer who signed off on the Complaint quit just after it was filed, so I suspect there's more than a bit of internal turmoil in the DOJ right now.

Does the White House not understand the suit the DOJ filed?  Or are they happy to let everyone else be confused?

I'd say "Yes," and leave it at that.
