The second Carroll judgment has yet to be filed (which starts the clock for any appeal, beginning with a motion for new trial. I still expect Habba to try to skip that step.) Ruling on the motion for mistrial may explain why.The bottom line, says Kaplan, is that what Trump's team pointed to as evidence of discovery misconduct was both too late and too imprecise to warrant either a mistrial or other sanctions, especially since they never showed that the messages were unrecoverable. 4/

Trump’s lawyers really do suck. They made a shitshow of the immunity appeal. No one really expects them to get the attention of the Supremes. And they threw do much conspiracy shit in the air in Florida the Special Counsel had to file a response.
It isn’t just Habba, and his fortunes don’t improve with new counsel for the appeal. Besides, thanks to the poor showing in the NY case and Weisselberg’s perjury, Engoron is likely to bankrupt Trump. And the testimony of that trial is likely to finish off the appeal of the summary judgment that’s already pending.
I don’t think the appeals he’s going to spend more money on are going to be worth the investment. His lawyers really suck.
