In his court opinion, Roberts clearly wanted the lower courts to chew over this issue of “official duties” (what are, what aren’t) for some time before returning the issue to the Supremes to answer in a particular case. (My guess is they find a procedural reason to put out this fire without getting their shoes dirty. But they’re only going to make Trump v U.S. look worse than it already does, whether they take it up for this case, or run away. For one thing, the immunity granted was supposed to be for criminal, not civil, liability. I’m sure they’ll decline the offer to expand their made up immunity. They can give that as a reason, or they can find a procedural reason, to reject this appeal. Either way, it again calls the whole concept into question.)
