“Besides if we made laws against misleading speech, maybe calling it fake news or something, it’s not like a place like America would ever wind up with fascists in power who would weaponize that.”

One more reason I'm glad I'm not "important enough" to pay attention to.I guarantee you that the first target of the "Stop Facebook Inciting Violence Act" will be some little blog. Won't even be BLM, lefty, or whatever. It'll be the Toyota Yaris User dot com or a Care Bears fan site. Just wherever there is drama, a rich butthurt guy and the law.

Fascist: Stop fake news. Media is the enemy of the people. Tighten up libel laws. Jail flag burners. Regulate or shut down sites that moderate in ways I don’t like.
— RiddanceHat (@Popehat) January 22, 2021
Super-Geniuses: Wow, we should put some limits on free speech so we don’t get a guy like that again.
Worked on a case where a guy gave a newspaper information about a Mountie having a profile on a BDSM website in uniform (and possibly committing sexual assault). A different police department got a warrant to investigate "criminal defamation" and absolutely tore his place up.

BREAKING: Texas Supreme Court REJECTS, without comment, appeals by Alex Jones and InfoWars, upholding lower-court rulings that allowed defamation lawsuits to proceed by parents of children killed at Sandy Hook AND guy misidentified as Parkland school shooter.

“First Amendment worship” is a bizarre way to describe the clearly accurate observation that legislation would be unconstitutional. https://t.co/uzgdbyv4mF

Feeling dumb because I didn’t anticipate the predictable-in-retrospect surge in appetite for poorly thought out censorship laws.

I don't claim to be the leading expert, but I've done a lot of historical work on the Fairness Doctrine. Here's a thread in case it's useful: https://t.co/wREo0AA8Cj

I know @AdamThierer has done some great work on it and knows a lot of the historical sources. Here's a thread of his with excerpts: https://t.co/qTsnJuBMco

Ed. note: I remember having those lyrics explained to me in 6th grade. Allegedly it had the word "fuck" in it. First time I'd heard that word. It was years later before I found out what it meant. Such was childhood when we freely roamed the streets of small town suburbia, gangs of little white boys in crew cuts with cuffed up blue jeans, white socks, and sneakers.or go back & read former CBS president Fred Friendly’s 1975 book (The Good Guys, the Bad Guys & the First Amendment) re: abuses of the Fairness Doctrine during both Republican & Democratic administrations. This stuff from Kennedy years, which I summarized in old book, is shocking pic.twitter.com/cByFb1iTq9

and then there was the "golden era" of broadcast regulation under Nixon, where regulatory harassment intensified to counter what had happened during Democratic administrations. See this 2007 @notjessewalker essay: https://t.co/ApEexwYfrG Snipped passage below is amazing. pic.twitter.com/KDmhKRV9lx

Ed. further note: I don't have a dog in this fight, so much as I think the conversation is a good thing. So, with Bernie as my new avatar:Elie -- and I know this will shock you -- phrases this deliberately provocatively, but the way I'd say it is "extremist speech can be countered by private individuals' and companies' exercise of free speech and free association, not government censorship."https://t.co/2Th5SXpWDc

*I think of Twitter as a series of guitar improvisations on-stage during a live concert in a football stadium. I.e., the kind of noise the crowd reacts to.I don't know about you, but this is the winner for me. pic.twitter.com/4e3B0N60N1
