There is going to be a big point at trial about whether Cheseboro was a lawyer or just a strategist/advisor. I expect Cheseboro to say he was a strategist and not paid for legal advice, which makes “on advice of counsel” defense harder for Trump.

Cheseboro is an unindicted co-conspirator. I expect him to say “5th Amendment,” and nothing more.

Trump has no “advice of counsel” defense unless he testifies. And then he has no defense.

And if you think this hearing is a delay, you really do only know court practice from bad TeeVee. Trump wanted a hearing next week; she gave him one Friday. And their arguments were a waste of the court’s time. If these orders are routinely resolved between parties, wasting the court’s time is not a good strategy.

You don’t want to go to court having wasted the court’s time. You use up a lot of goodwill you might need.
