So where does DOJ go from here?
Appealing the dismissal instead of re-indicting is a way to kick the can down the road and avoid a lot of short-term humiliation over the other flaws in the case.

I mean you could drag an appeal out for a year, easy. That way you’re not faced with litigation of the embarrassingly meritorious vindictive prosecution motions or any of the other trash-fire elements of this; you get to litigate a dry statutory interpretation issue.

You’ve already flexed your power and cheered up the base by going after Enemies of the People and cost the defendants a shit-ton of money and stress. So just appealing and not trying to re-indict may be the smartest course.

Which is why I’m not sure they’ll do it, as absolute morons.
Appeals would allow Bondi to blame the judge (that’s literally what appeals are), without taking any responsibility herself. But as Alito (IIRC) wrote an opinion upholding the judge’s interpretation of the statute, I don’t give them much hope of success. Still, as I say: who’s going to try again this time if they don’t appeal?

And it’s also clear Ahab isn’t through chasing his white whales:

Or that he’s just on a humiliation kick. No, that’s not about Comey. That’s about Hegseth’s investigation of Mark Kelly. Trump wants his enemies brought before him, in chains. Again, he’s never going to get it. But still….

That Zeteo article is about how “we” are numb to this. But this is the better analysis:

Secretary Hegseth’s tweet is the first I heard of this. I also saw the President’s posts saying I should be arrested, hanged, and put to death.

If this is meant to intimidate me and other members of Congress from doing our jobs and holding this administration accountable, it won’t work. I’ve given too much to this country to be silenced by bullies who care more about their own power than protecting the Constitution.
When they go low, we go high. And kick ‘em in the teeth.
