Short version: Jack Smith didn’t testify to what he wasn’t asked about. It’s settled law in the D.C. Circuit that it can’t be perjury if the information wasn’t sought in the first place.

Bonus points for setting up a vindictive prosecution defense if Blanche decides to press the criminal referral (which it is, in the active sense of that word).
