This Is How Courts See Stupid Statutes

Yes, legislatures have tremendous power and can pass a broad range of statutes.  But those statutes have to have a rational basis, and when they don't, they face analysis from the courts. This which boils down the decision quite nicely:

"While Plaintiffs advance substantial unrebutted evidence showing that they are likely to suffer significant financial and reputational harms absent an injunction, Defendant fails to articulate or provide any evidence of harms that the state would suffer if an injunction was entered," said Judge Williams. "And while NCLH has demonstrated that public health will be jeopardized if it is required to suspend its vaccination requirement, Defendant identifies no public benefit from the continued enforcement of the Statute against NCLH."

Norwegian Cruise Line shows they are going to face damages from the Florida law; Florida, on the other hand, can't show any public benefit arising from the statute.

That's pretty much how courts look at laws like this.  By the way:  don't travel to Florida.

"The viral load in Florida is so high right now, there are only two places on the planet where it's higher… It's so high in Florida that I think that if Florida were another country, we would have to consider banning travel from Florida to the United States," he said. 

"DeSantis' banging on Biden inflates his 2024 stature among GOP voters."  Yeah, how long is that gonna last? We’re not a year in, but Biden’s approval has fallen and he’s done for. That’s what all the kewl kids on MTP said Sunday. But when the infrastructure bill passes, and the reconciliation bill passes, and Covid is still ravaging Florida (because the DeSantis leopard won’t change his spots), is De Santis still going to be puffing up his stature? Or will reality puncture his inflated balloon?

2024 is a long way off. Sooner or later, DeSantis is gonna be held responsible for Florida; not Biden.
