Maybe The Panel….

9th Cir. grants an administrative stay blocking Judge Immergut's order that the National Guard not be federalized, but notes that bc DOJ didn't appeal her second order forbidding their deployment the effect is that the NG can be federalized during continuing litigation, but not deployed to Portland.
...needs to see this: For the life of me, I can’t figure out what “secret knowledge” the panel thought it had to credit to Trump. The record is perfectly clear, in court as well as out of it.

Already we have a DOJ so denigrated and corrupted it fucks up an appeal it won, this badly. If the DOJ decides to appeal to the entire court, or files a new appeal, they may get a new panel, or get the entire court to review all the issues. Do they want to make the fuck up worse? Or quit while they’re ahead?
Department of Justice lawyers, from Main Justice to AUSAs in the districts, have ALWAYS enjoyed a sort of aura of truth and justice and trust. That was arguably always unjustifiable but Trump DoJ has absolutely pissed it away with compulsive lying.
The failure of that presumption is going to trickle up to the appellate courts eventually, and encompass the Presidency as well.

Trump is his own worst enemy.
