"We, the people,” in the Preamble, explicitly did not include slaves. And slavery in America was based entirely upon race. And race was not considered a “pernicious” category in the law, until the latter half of the 20th century. Before that it was perfectly permissible to discriminate on the basis of race, in law.That’s the Declaration of Independence, not the Constitution.
