A doctor is welcome to perform an abortion to save a woman's life, or to prevent serious harm or infertility in Idaho. However there is nothing in the order that actually shields a doctor from criminal prosecution. So on one hand a hospital might be putting some of its Medicare funding at stake, and on the other the doctor could be subject to criminal prosecution and imprisonment. So yes, there is a choice but it is meaningless. Women will be bleeding out in hospitals and receiving no treatment. The conservatives in the dissent made clear they would have ruled for Idaho, Medicare can't overrule a state criminal law. Given that it is almost guaranteed we will get that decision later, is there any way to write a Federal law that would mandate basic care if a state makes providing the same care a criminal offense?So Idaho is still in the same position as Texas: face criminal trial to show you didn’t violate the law.

"If the DIG order is the final decision, then what happens next is this case goes back to the en banc 9th Circuit, which will likely affirm the district court's finding that EMTALA trumps Idaho's ban," he explained. "Idaho could try again to get this SCOTUS to review, but see current gridlock."
One step forward, two steps back. EMTALA is a law from 1986. The Supremes are basically refusing to deal with it. This decision will leave a conflict in the districts, classically a reason for the Court to rule.Re EMTALA decision, remember that the Court allowing litigation to unfold in Idaho (good bc of injunction) also essentially allows a bad 5CA order holding that EMTALA does NOT preempt Tx’s abortion ban to stay in place. Given the populations in TX vs ID, that’s not a win.

Despite Trump screaming about the economy (with media help), the economy is more favorably regarded as time passes. What really tanked Trump’s polls? A felony conviction, for which he will at least get probation before the GOP convention.
