In Idaho; not in Texas. The 5th Circuit explicitly denied application of EMTALA against the same law Idaho has.

Idaho population 2024: 1,990,456

Texas population 2024: 30,976,754

The population of Austin, one of the smaller major urban areas, is 2,274,000. Just to put it in stark perspective.

And Alito compared abortion to experimental cancer treatment in his dissent. Which is ignorance and jack-assery on a whole new level.

Honestly, the reporting is so half-assed:

A doctor is welcome to perform an abortion to save a woman's life, or to prevent serious harm or infertility in Idaho. However there is nothing in the order that actually shields a doctor from criminal prosecution. So on one hand a hospital might be putting some of its Medicare funding at stake, and on the other the doctor could be subject to criminal prosecution and imprisonment. So yes, there is a choice but it is meaningless. Women will be bleeding out in hospitals and receiving no treatment. The conservatives in the dissent made clear they would have ruled for Idaho, Medicare can't overrule a state criminal law. Given that it is almost guaranteed we will get that decision later, is there any way to write a Federal law that would mandate basic care if a state makes providing the same care a criminal offense?
So Idaho is still in the same position as Texas: face criminal trial to show you didn’t violate the law.

I dunno 🤷🏻‍♂️. Maybe the ERA would have “fixed” this. Except I’m sure the Roberts Court would gut that, too.

We really are down to “the law is what 5 people say it is.” And they are all there for life.

But here are the facts: Before the pandemic, America's GDP was 2.5 percent, all right? Post-World War II, that's not the greatest performance ever. Political Science

I wasn’t in favor of it when the CIA did it. I wasn’t in favor of it when Trump and half (at least) the incumbent GOP did it (about as well as the CIA did).

Turner Hall Ballroom will host a yet-to-be announced organization, but that arrangement was made for the DNC in 2020 before the convention went mostly virtual.

It’s 100% a case of ‘overpromise, underdeliver,’ on all parts, by everybody,” he said. 
“We were told it was going to be one way over and over and over and over again when (the RNC) was confirmed, and it has turned out to be almost anything but the way that we were told it was going to turn out,” Witt said. “We were sold a storyline of how this is going to go, and basically it didn't go anything at all like the storyline that we were sold.”
A Trump event, in other words. ETTD. It’s an iron rule of the universe. Irony alert: "despite Trump’s takeover of the RNC.”

And somehow this seems to fit:
The RNC can’t organize a two-man funeral procession. The local Democratic parties are organized enough to be hiring. Guess they’ve got the money for campaigning, huh?

Keep Awake! -Mark 13:33

Mr. Dooley said that the Supreme Court follows the election returns. He didn’t mean on a two or four year cycle, but following the appointments of justices. Thomas has been on the Court since Bush pere appointed him. The election returns have bent toward conservatives (Republicans) ever since.

We can stay awake on church/state separation all we want. But we slept for forty years, and only if we wake up  now (why do you think the architect of the Court, Leonard Leo, denounces “woke”? And yet he’d resent being called a racist, even though he wants to return to a pre-Civil Rights era) can we shape the future. But not by worrying about what this Court will do (that course is set). We have to wake up to shaping the Court, and the government, that we want.

The future is where the fight is now. The Supreme Court follows the election returns. Slowly; but it does.

If I Understand Correctly…

The District Court ruling raised Idaho to the status of Texas: abortion for “emergencies,” but what is an emergency?

“Serious harms” may be slightly more generous than “life of the mother is at risk,” but clearl definitions are still needed. The Texas Medical Board has refused to provide any guidelines on how to determine if the abortion is necessary for the “life of the mother,” the statutory standard in Texas. I would remind you a pregnant woman was septic and still had to leave the state for an abortion. Because of the delays, she’s now incapable of pregnancy ever again.

But hey, she’s alive, right?

What circumstances make abortion legal depend entirely on 12 jurors and the DA who brings the criminal charges.  OB/GYNs in Texas face a “damned if you/damned if you don’t” choice. I wouldn’t be surprised to see the number of practitioners diminishing sharply.

Is Idaho simply rising to the level of Texas? I wouldn’t call that a “rise” at all.

I stand corrected. Idaho abortion law already matches Texas law on the “life of the mother” exclusion.
"If the DIG order is the final decision, then what happens next is this case goes back to the en banc 9th Circuit, which will likely affirm the district court's finding that EMTALA trumps Idaho's ban," he explained. "Idaho could try again to get this SCOTUS to review, but see current gridlock."
EMTALA is the Emergency Medical Treatment and Active Labor Act. The trial court issued an injunction to apply the standards of the Act. However: One step forward, two steps back.  EMTALA is a law from 1986. The Supremes are basically refusing to deal with it. This decision will leave a conflict in the districts, classically a reason for the Court to rule.

But the women in those states can wait, right?

I hear the "cocktail" is 2 Red Bulls mixed with a liter of Mountain Dew chased by a Panera “Charged Lemonade.”

They force Biden to chug it right before he goes on stage.

He uses teleprompters to deliver the same speech over and over. And when he goes off script he starts talking about sharks and shampoo and washing machines. Although it’s hard to be sure that isn’t part of the script.

He’s even complained about the quality of the teleprompters at at least three rallies.

Joe Scarborough Nutshells It For You

"Yeah, they can just hop up and suddenly turn around and suddenly have the largest NATO alliance in world history, and you have the best jobs numbers in 50 years," Scarborough continued. "They can take a swig of Mountain Dew one moment, the next moment the dollar could be at a 50-year high. They can snort that Mountain Dew up, and since they're so old it's coming out through the nose, and that gives them the inspiration to and they say to themselves, 'Hey, I may be completely out of it but I'm going to do something that none of the preceding five presidents did, and I'm going to put together more bipartisan legislation than any other president since [Lyndon B. Johnson] – that's what I'm going to do." 
"This is desperation, and like you say, like, you know, this shows how nervous they are," Scarborough added. "This is not how somebody who is confident acts. I never heard Larry Bird talking about, Magic Johnson is probably going to be jacked up on Mountain Dew, we're not going to be able to beat the Lakers. I can't believe I'm saying this, Trump is scared out of his mind. He's whining and whimpering because Joe Biden may just beat him really badly. I don't know, you tell me – why are they running so scared from Joe Biden, a guy who they've spent the last eight years saying is out of his mind?"
No notes. Except to wonder why the “objective” political press can’t report it that way.

If Donald Trump Has Superpowers…

The thing I suspect, if you're sort of reading the tea leaves this week, it sounds like they are suggesting the vice president pick may come this week, and, if so, that is one more way they are hedging against a bad debate loss," Scarborough said. "What you do if you get really bad headlines coming out of the debate on Friday morning, you make sure that throughout the weekend they are not talking about the debate. Instead, they are talking about your vice presidential pick. Even the leaking of that is a possibility shows they are scared. I mean, they are really scared Donald Trump is going to blow this thing." 
"That might be a contingency plan," [Matt] Lewis said. "If the debate goes well, we hold the announcement. If it goes poorly, we bracket it with the vice presidential announcement. I have to say Donald Trump, he is really good at controlling the message, there no doubt about it, and changing the subject. It used to be something like a debate would be talked about for weeks on end and it would dominant multiple news cycles. That may not be the case. Maybe he says or does something either important or just crazy, and that is what we are talking about a couple of days from now. He is really good at that. Bad in a lot of other things but good at driving the agenda and our attention."
...why does he keep losing?

He surprised everyone by defeating Hillary Clinton, who was a great policy wonk in a long line of Democratic policy wonks who were lousy politicians, and Trump still only won in the electoral college.

And he’s lost everything since, including the Congress and 60+ lawsuits in 2020, along with every court trial he’s been involved in, in 2024. Trump changes the narrative? His testimony in the three civil trials destroyed him, his refusal to testify in his criminal case didn’t save him (it wouldn’t have helped him, either). The narrative in all four cases chewed him up and spit him out.

What Lewis is talking about is changing the attention of the press, which is always distracted by the next shiny bauble; or just a butterfly. 🦋 But Lewis’ assumption is that the press narrative matters; which is the same reasoning that thinks Twitter matters:
The MSM is slavishly devoted to the next crazy thing Trump does (unless he says it at a rally, and then it’s a dog bites man story). To be fair, political Twitter is no better. But neither political news nor political Twitter (nor political polls, for that matter), are real life. Just because the press is chasing the next shiny bauble doesn’t mean the electorate is following. Despite Trump hammering on Biden’s age (with a lot of media help), Biden is rising in the polls. Despite Trump screaming about the economy (with media help), the economy is more favorably regarded as time passes. What really tanked Trump’s polls? A felony conviction, for which he will at least get probation before the GOP convention. And depending on what the Supremes finally do, Trump could go to trial in October in D.C.

The political narrative is whatever Trump said last because all Trump does is talk, and because there’s a conservative bias in American media (prove me wrong). But the political narrative is not real life. If Americans are not “paying attention to politics,” what makes you think they’re paying attention to political pundits and reporters? The political narrative is always and only about the horse race, and Trump isn’t really in the horse race. He’s campaigning less to win office than to pay his lawyers. He walks back his idiot policy proposals, promises to cut off federal funds from every school in the land (because all 50 states have public health laws about vaccines), and the rest of his campaigning is sharks, electric boats, and washing his hair.

And frankly, if the press would cover those statements (there’s video! You don’t need three corroborating sources!) objectively (“Just report what he said!”), it would go a long way to balancing the political narrative.

It might also kill the narrative that Trump controls the narrative. That control is actually in the hands of editors who decide what to report, and what not to report.
