Except one is a position completely at odds with our entire system of laws and our Constitution, and the other is entirely in accord with our laws and our Constitution. However, both issues will be (indeed, one already has been) resolved by the courts, where disputes over the application of the laws is supposed to be resolved. But one of them is a terrible, no good, very bad, horrible idea; and the other is not.
And which one is which depends entirely on what you think of Donald Trump.
A government of laws? Or of one man?
