I never look to law professors for advice on when to go to court. Prosecutors and litigators have a much better handle on that. Tribe may be a brilliant ConLaw professor. I wouldn’t want him representing me on a traffic ticket./4 So: under current law I think to make a charge of seditious conspiracy you would have to show he conspirators intended the force used on January 6. Is that possible? Yes. Is it easy? No.
