The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress....The fun part will be watching this never happen. Republicans don’t control 3/4’s of the House or the Senate. And the odds of them doing in the next four years or so are zip and none. I also think I can count up at least 13 states right now that would deny approval, if only because sauce for the goose is sauce for the gander.
Ironically, it could be the same reason a Constitutional amendment overturning Trump v US would pass. Immunity for Trump is also immunity for the next Democrat in the White House. And it wouldn’t pass soon enough to affect Trump.
Although it now applies to Biden, which might make it even easier to revoke. 😈
