The Court Made Short Work Of DOJ’s Responses

You will recall that, in our last episode, the government was telling the court it couldn’t answer any questions about who did what when with regard to the foreign incarceration of Abrego García. Professor Vladeck was stunned by the government’s obstinacy.

The court, it turns out, was not having it.

Defendants—and their counsel—well know that the falsehood lies … in their continued mischaracterization of the SCt Order…. Defendants’ objection reflects a willful + bad faith refusal to comply w discovery obligations.

The order, in sum, is: asserted privileges and grounds for refusal respectively denied and overruled. Answer the questions and make it snappy.

I’m not sure what the rules of procedure allow for an appeal, but one is incoming ASAP.  It will probably get the same reception that the trial judge gave these answers, but delay and denial is entirely the point.
