I Should Have Waited A Few Hours

Appellate Division to Trump: “Not happening.”

An appeals court in New York State has denied a request by former President Donald Trump to suspend a summary judgment in Attorney General Letitia James' civil fraud case against him and his adult sons, reportedThe Washington Post Friday.
The appeal is on; the stay is not. Because there’s no need for it:
Deputy Solicitor General Judy Vale, on the other hand, called Trump's demand for a delay “completely meritless” and noted that the state is willing to delay proceedings over ownership of Trump's properties until the trial is concluded.
I assume the court’s order this week regarding reporting transfers of assets is still in force, as that just preserves status quo until final judgment. If the trial court finishes before the appellate division does, a stay might preserve things while a review is conducted. But the special monitor would still be watching everything so defendants don’t loot the assets and send them to Switzerland. Or the Caymans, or however they do that stuff in real life.

A stay of execution, analogously; but not a commutation of sentence. And honestly, unless Trump’s lawyers can do better than “economic chaos” and “thousands of jobs lost,” they don’t have a lot going for them on appeal.

Bank robbers with families to support go to jail everyday. The courts don’t hold justice because the children will be affected. Yes, that’s cold and harsh, and no, I’m not sure it’s “justice.” But fraud vitiates everything; and that “everything” is pretty damned inclusive. And it won’t be the first time in recent memory a New York company was forced out of business for fraudulent practices, and thousands lost their jobs. Like I say, if that’s your argument, you might as well quit wasting the client’s money now.

  1. Your honor, sentencing my client to prison for his crimes will cause him to lose his freedom.
