“It’s not my fault your windshield was broken!”
Jason Flemmons, who qualified as an expert on accounting, explicitly called out accountant Donald Bender, who represented Trump at the firm Mazars USA and who testified for the prosecution that he would have wanted to see appraisals conducted by the Trump Organization, reported ABC News.
Flemmons, however, testified that lenders should have noted the "buyer beware" signals sent by "highly cautionary language" in their disclaimer, which he said would have allowed Trump to make claims that departed significantly from generally accepted accounting principles.
He also placed responsibility on Bender and his colleagues at their accounting firm for any inaccurate statements on the Trump Organization's financial records. That argument might just flummox a jury, especially if the jury charge broke the defendant’s way. But in a bench trial? Worse than useless.
Trump is running this trial, not his lawyers. A settlement is inconceivable.
