Let’s You And Him Fight

Roe v Wade started in a federal district court in Texas in 1969.  Because Texas appealed the trial court decision to the Supreme Court, the case was argued therein 1971.  The case was decided in 1973. 

Plyler v. Doe was filed in September, 1977, and decided in 1982.

That’s the timeline Professor Tribe is implicitly advocating, because any case brought by parents in federal court in Texas would be taken by Ken Paxton to the Supreme Court, directly or through the Fifth Circuit.  By that time your child will either be in private school, almost out of Texas public schools, or just kept at home until the pandemic eases.

As a parent, what would you do for your child?  Spend the college fund on litigation?  If you have that much money, odds are your kid is already in private school, and it doesn’t matter to you.

Going to court is seldom the solution it’s cracked up to be.
