Civics Lessons

Within the constitutional system, who is it that has the power to declare governmental actions unconstitutional? The courts. Which courts? All of them, starting with the trial courts. And what if you think the trial court is wrong? You appeal. And the next court gets to hear the case. And it can go up to the Supreme Court.

And those courts get to decide what is, or is not, constitutional. Not a single Senator. Not the entire Congress. And not the POTUS. Just the courts. And no one court, except for the Supreme Court.

But no one person. Ever.

Do we really have to explain this?
