The problem with prosecuting the leak of classified information is that there has to be an elaborate process to protect exposure of that information in court (this was part of the reason for the long pre-trial process in the Florida documents case).You don’t need to leak false information. But if the information is false, the problem is proving the harm.
And if the leak is true, but pertains to giving the information to someone without security clearance or a background check, the problem is: why the hell didn’t you protect that information from that guy? But you want to prosecute this guy for revealing “national security” doesn’t mean what you say it means?
Granted, Trump’s DOJ seems stupid enough to do that…but I’m not holding my breath that Elmo’s snit becomes a serious investigation, if only due to the blowback factor.
