I'm guessing this follows from legal advice provided by the firm of Giuliani and Bannon.

Asked a top Trump adviser about Giuliani's prominent role in the post-election effort. Said Giuliani remains "very close" to Trump, seen as a generational peer who will make attacks others in WH avoid, and noted that Giuliani is now close to Bannon.
