Actually the question is: if race is not a factor, why is the Court determined to rule on it?

I thought the Court wasn’t political. And the authority of the Court rests on the Court ruling on facts, not acting as a super-legislature deciding policy issues.

Seems to me Alito walked into it.

It’s a settled principle (more honored in the breach than in the keeping) that courts rule on the case before them, not on what they’d like to see in the law. The Roberts Court is not honoring that principle in the breach, they are tossing it in the paper shredder.
