Not that the Roberts court doesn't play fast and loose with the facts when it suits them, but...

This doesn't go to the declassification question (which I doubt Trump's lawyers truly make a strong assertion about), but it does go to misrepresentations by Trump's counsel, to the Court.

In the case of the praying football coach (who wasn't suspended, just not renewed in his contract the next season), the Court ignored the record.  Here, the record is being misrepresented by counsel.

If this matter gets beyond Thomas, that could be a factor.  If not, it will be in the lower courts, since the representation is now part of the record.

Courts don't like being lied to.
A case in point: The trial court quashed the subpoena based on representations made by Paxton. When the court found out those representations were less than accurate, it decided Paxton should testify after all.

The court was not amused, shall we say.
