Two points

1) It's not a matter of precedent, but of black letter law (there really isn't any ambiguity in the statute).

2) Can't keep the story straight?
BTW, Pat Toomey is on MTP arguing the "whistleblower" call (calls?) were "private." So there's a legitimate controversy, not a blatant abrogation of black letter law.
